Terms and Conditions 

 

Booking Fee / Deposit Payment

A non-refundable booking fee of 20 % from chosen package total amount as well as full acceptance of the terms and conditions secures the time and services of the Photographer for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance due. Payment in full of the remaining balance will be due one calendar month before the wedding day. Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time. The contract shall not become effective until the initial booking deposit amount due has been paid. At the time the contract takes effect, Rey Weddings Ltd shall reserve the date and time agreed upon, and not make any other reservations or accept any other clients for said date and time. Requests to change an already booked photography or videography package to a lower cost package is also considered a cancellation. Payment for albums or additional album photographs, prints & frames is made after the wedding at the time of ordering.

Following payment of final amount for Rey Weddings Ltd services, balance of payment is due no later than 6 weeks before the wedding date. No photographs, Video or wedding albums will be available for draft preview or delivered until all payments due have been paid in full.

Additional extra hour outside booked package at wedding day is 150 EUROS (£) each photographer/videographer

 

3.Copyright

The 1988 Copyright Act assigns the copyright of the images and videos to the photographer and videographer. It is contrary to the Act, and therefore illegal, to copy these images or videos or allow them to be copied, by any means photographic, by computer, internet or otherwise, by any person or machine other than by the photographer or without his consent.

Supplied digital files remain the copyright property of the photographer/videographer. Rey Weddings Ltd allows the client to store/share/copy/print all images for personal/friends/family use only, subject to no commercial or financial gain.

Suppliers from the day can use images or/and videos for their portfolio. The images and videos must be credited to Rey Weddings Ltd, and they must email flashpro-studio@outlook.com to arrange usage rights for the images and/or videos they wish to use.

 

4.Display

The client(s) hereby allow(s) the photographer/videographer – Rey Weddings Ltd to display any photograph and videos covered by this contract and to generally promote the business in advertising, brochures, magazine articles, social media, websites, blogs, sample albums and prints, venue and other vendor samples, and other such material, providing that the images used are used lawfully and without damage to the client(s).

 

5.Artistic License, Retouching and Editing

Rey Weddings Ltd team keep right to be granted complete artistic License including in relation to the poses photographed and the locations used. The photographer(s)’ judgement regarding the locations/poses and number of images taken shall be final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.

The Photographer(s) and / or Videographer(s) shall endeavour to photograph or film all individuals as requested by the Client(s) at some point during the coverage, but no responsibility will be taken by the Photographer(s) and / or Videographer(s) in the event of leaving somebody out.

For video bookings, audio capture of the bride/groom/celebrant/readings are made during the ceremony but depending on the contact and video package booked, the audio of those moments may not be included in the final video.

For video bookings, audio/visual recordings of extra live performances (e.g. Live Bands, Violinists, Saxophonists, DJ’s, MC’s and Wedding Singers) during the wedding coverage period are not specifically covered and included in the video edit unless specified and agreed to in the booking contact and planned for in advance. Extra recording equipment setup and pre-planning is required for such performances. This also applies to audio recording of impromptu readings or statements/comments made throughout the coverage period which are outside the scope of normal wedding events as these would need to be planned for and setup in advance to be properly captured.

For video bookings with speeches included, audio/visual recording of wedding speeches are recorded and produced in their unfettered/unedited entirety per speaker. Depending on the level of package booked, crowd/guest reaction “B Roll” footage may also be included and edited in. Speeches are normally supplied as separate chapters to the wedding full video.

As photographer(s) and videographer(s) we own the full artistic license during the photographing and the filming during an event i.e., we decide what is actually captured at the event and the subsequent photo editing and video editing. Specific client instructions to edit, retouch or airbrush individual photos e.g., background object removal, skin smoothing, blemishes, scar, tattoo removal and body contouring etc. will incur an extra time in editing costs and will be assessed on a photo-by-photo requirements basis.

Rey Weddings Ltd team keep right to make photographs and video films editing in style they do. Photographs editing its clearly seen on photography portfolio.

Video films editing style and music choosing for video highlights and films is video editor style and is clearly seen on video portfolio.

Rey Weddings Ltd team video editors using only legal songs and music from, Epidemic sound, music platform.

If client request for photographs or video films re-editing, it will take effect of additional cost, who have to be discussed with editing team.

The client shall not direct or specify any specific editing of photographs or video editing for the final product. Any specific client requested requirements to re-edit the delivered video or film will incur extra editing costs and will be cost assessed on a scene by scene change requirement basis including the resulting extra time required for post-production, re-compilation encoding, uploading and delivery. The only eventuality when we will re-edit video or films is when an editing problem or mistake in our production has been detected by ourselves or the client and brought to our attention.

 

5.1 Consistency. Photographer will use reasonable efforts to ensure that the Services are produced in a style consistent with Photographer’s current portfolio, and Photographer will use reasonable efforts to consult with Client and incorporate any reasonable suggestions.

 

5.2 Style. Client acknowledges and agrees that:

  • Client has reviewed Photographer’s previous work and portfolio and has a reasonable expectation that Photographer will perform the Services in a similar style

  • Photographer will use its artistic judgement when providing the Services, and shall have final say regarding the aesthetic judgement and artistic quality of the Services; and

  • Disagreement with Photographer’s aesthetic judgement or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned.

 

6. Images and Digital Files

Images and/or videos will be supplied via digital means as download files. It should be noted that you are strongly advised to immediately copy/backup your wedding photographs and/or videos from this download to a suitable computer/storage device. Digital media has a limited lifespan therefor any storage device cannot be guaranteed indefinitely. Also, please note that Rey Weddings Ltd are under no obligation to keep copies of your images and/or videos once released.

Original photo and video digital files are stored for a period of 1 year from the date of the event and then deleted. Retouched images are stored for a period of 1 year from the date of the order and then deleted.

 

7. Number of Images and Video Films Timing, Raw Material

Although Rey Weddings Ltd will do their best to produce more images than discussed with the client, there is no guarantee that any particular number of images will be produced. All images presented to the client are FINAL SELECTION, any other images will not have passed our quality control and therefor will not be processed or released to the client – EMPHASIS SHOULD BE LAID ON THIS POINT.

All Video films and highlights timing is on, (up to) point and is means that can be shorter then is said in client booked package. If wedding ceremony timing or speeches timing it comes over full video final timing, Rey Weddings Ltd team have right to leave best moments from ceremony or speeches to fit in final video time, who was chosen by client on booking. If client wish to keep all full ceremony, who is over standard civil ceremony or church ceremony timing and can take over agreed final full video film timing or full speeches, who is come over standard 25 minutes timing and come over full video final timing, there is option to edit longer final full video for additional fee., who have to be discussed and written agreed with Rey Weddings Ltd editing team.

Rey Weddings Ltd do not provide any Raw material for client in any case - no raw photographs or raw video material.

 

8. Wedding Arrangements

The details of the wedding arrangements are to be agreed beforehand in writing (email is acceptable). The Client shall notify the Photographer of any changes to these details in writing. The Photographer/s cannot be held liable for delays or disruption in their delivery of the service until any changes are received and acknowledged in writing.

 

9.  Cooperation

The Clients and the Photographer consent to cheerful cooperation and communication with each other in order to achieve the best possible result within the understanding of this contract. We recommend that the Photographer be provided with someone who knows most of the guests, who will point out key individuals to be photographed. The Photographer may also require assistance in organizing family groups. The Clients also agree to give the Photographer sufficient warning of key events to give the Photographer time to prepare e.g., cutting the cake, speeches etc. Please note that not all guests like having their photos taken. In such cases the Photographer will use his discretion but cannot be held responsible for a lack of photos of these people.

 

10.Freelance Photographer Guests

Each one of your guests will have digital cameras and all of them will want to take photographs during important moments. In the spirit off friendly collaboration, the Clients agree to give the Photographers precedence over the guests in order to take the photographs required for the Event services described above. I cannot be held liable for a lack of Event photos if guests taking their own photos of the Key moments continually interrupt the Photographer's work.

 

11.Licenses, Coverage and Reproduction

a) Photographs taken during the course of the event will be at the discretion of the photographer(s) although every effort will be made to comply with The Client(s) requirements.

b) The photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.

c) For a booking involving a church ceremony or at certain venues, the photographer(s) movements are sometimes restricted by the official in charge. The area from which the photographer(s) is able to cover the ceremony may not be the photographer(s) choice and the photographer(s) cannot accept responsibility for any obstructed view should this be the case. The use of artificial lighting may be restricted or prohibited. The photographing of parts or even all of the ceremony may be restricted or prohibited. Client(s) is strongly advised to check with the appropriate official before booking the date and submitting this contract.

d) For a wedding or other event booking the photographer(s) shall endeavour to capture all the moments throughout the day as they occur. However, because of the fluid nature of the event, some moments might not be recorded, or not recorded for logistical reasons.

e) Please note that any alterations made to the booking by the client(s) once details have been confirmed may only be made at the discretion of the photographer and in some circumstances (such as the change of ceremony date for a wedding) the photographer may be unable to accommodate these alterations due to a conflict of commitments. Under these circumstances the photographer is not liable to compensate the client(s) in any way whatsoever.

f) Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs. Please note that certain colours do not reproduce exactly in print.

g) It is understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not be identical over the whole range of colours within a subject. It's also understood that prints made at different times or in different sizes may be variable in colour balance.

h) Due to the limitations of computer monitors it is understood that:

(1) images appear differently according to the specification of each monitor

(2) prints will not match images rendered on any particular computer monitor.

i) All print and presentation sizes quoted are approximate and subject to the discretion of the photographer(s).

j) Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer(s) will not be responsible for photographs that are not produced due to technical failure, either at the shooting or processing stage.

k) Exclusivity. It is agreed that the Photographer(s) shall be the sole professional stills Photographer on the wedding day. Although the Photographer will actively encourage the use of cameras throughout the wedding it is agreed that the Photographer shall reserve the right to ask guests to refrain from taking photographs in the event that their activities are corrupting the official photography in any way.

l) Images are not to be edited by anyone by Rey Weddings Ltd , this includes Instagram filters or anything that might alter the look and style, or change integrity of the photography work, unless this has been otherwise organized with Rey Weddings Ltd team.

If formal group shots are required i.e., Bride, Groom with Bridesmaids, Best men, Mums, Dads & close family etc. then please supply a named list of around 10 groups. This keeps things organized and so not to waste time and spiral out of control on the day. Around 3 or more shots per group are taken to make individual group shot order choices.

Should the photographer notice that a member of the wedding party or guest has been seen to blink/closed eyes, the photograph will be taken again but it is impossible to guarantee to see all of them.

 

12.Personal Accident.

Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said person's own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

 

13.Cancellation Fees, Date and Package Changes

a) If The Client(s) should have to cancel a booking, the retainer and any other fees already paid cannot be refunded.

b) The Client(s) may change the date booked earlier, if somebody else has not booked it already. No additional charges apply, and written consent is required. The photographer cannot take responsibility in the event when the new date is booked, or other responsibilities need to be carrying out on this date. No refunds will be given.

c) The Client(s) may upgrade or degrade the package at any time. No additional charges apply, and written consent is required. The Client(s) has to pay the difference between the amount already paid and new amount due. Any differences cannot be refunded when degrading the package.

 

14.Limit of Liability:

If a photographer is too ill or becomes injured and cannot supply the wedding services specified above the Photographer will try to book a replacement wedding photographer. Under normal circumstances a second photographer from the Photographer is there for the day any way and this photographer will then shoot the day on his/her own. If both photographers are unavailable and a replacement photographer cannot be found, then liability is limited to a refund of any payments received.

 

15. General

10.1 Notice. Parties shall provide effective notice (“Notice”) to each other via either of the following methods of delivery at the date and time which the Notice is sent:

 

10.1 Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the Services and supersedes all prior agreements and understandings both formal and informal.

 

10.2 Severability. If any provision of this Agreement is determined to be illegal, invalid or unenforceable, in whole or in part, by an arbitrator or any court of competent jurisdiction, that provision or part thereof will be severed from this Agreement and the remaining part of such provision, and all other provisions will continue in full force and effect.
